I am really displeased about the way Saxon Mortgage conducts it's business. After 7 months of faithfully making payments ON-TIME under the home modification trial periods. Saxon calls me and alleges I am denied modification due to lateness. I have made payments before or on the 1st of the month as required. This grossly false and I will prove that Saxon Mortgage is running a scam to milk consumers of hard earned money. This means that they have been taking my money and not applying it to my mortgage, making it look like my account has been deliquent.

I need someone to help me before Saxon Mortgage takes my home, they have ripped me off already.

I can not believe this site that I just stumbled across my husband and I filed in June of 2008 for the modification of our home loan and we have been on trial payments ever since. We too have been receiving notices that we did not have all the required paperwork and so we go back and forth calling and they say yes it is all here and a few days later we receive another notice for info on and on then out of the blue we receive a letter with intent to foreclose

We call Saxon Mortgage and they say that there is an error between them and the modification company and to ignore the paperwork. Then I receive yet another call from them stating that they need more paperwork that they did not receive I figured this is good since they are contacting me RIGHT??

However, a few months pass and I get another notice in the mail stating that we do not qualify for the program and they give us a phone number to call with any questions so I call this phone number to be told by the agent that the phone number I have dialed is not part of the modification process and they can not answer or help me only to tell me that according to their files my paperwork is still in underwriting and that we need to continue to pay our trial period payments.

I am so confused and I am asking for anyone that has any answers of what we should do PLEASE HELP

From: "SanTysha Douglas"
You are receiving this correspondence because you have expressed interest in joining a potential class action lawsuit against Saxon Mortgage Company.

Please be advised that after numerous consultations with attorneys, we have concluded that, based upon the variety of potential claims, the Law Offices of Craig Hosay is unable to pursue a class action suit against Saxon Mortgage Company.

This is not an evaluation of your particular case. If you have not done so already, you should consult a local attorney regarding your options under your state’s law as well as any applicable federal law.

Please be advised that any claims you may have are subject to a Statute of Limitations which may forever ban your claim if not timely pursued. The length of the Statute of Limitations applicable to your potential claims may vary from that applicable to others’ claims, as they are based upon your specific claims as well as your state’s law. We therefore cannot say what the period applicable to your claims may be. You should contact a local attorney for help in determining the time remaining in which you may pursue any claims you have.

If you have any questions, please contact me at the above information.

Respectfully,

Craig Hosay, Esq

It all came crashing down for me today- my modification paperwork lowered my monthly payment by $5.00 , I was current when all this began and now I am 48 days past due and owe over $4500- if I don't sign the modification they will begin forclosure process. I have never missed a payment in 10 years. This is an absolute crime and a disgrace. I am a single mother and decided not to sell my house because this new program would save me finanically - now I am in a world of difficulties I would never have had if I had just not inquired about this program..class action is deff needed- I am in.

If I am not able to find a pro bono lawyer I will be looking at retaining a lawyer this coming Monday, Feb. 22, 2010. They are foreclosing on my house in three weeks, despite a year and a half "dance" with them. They sent me a loan modification, I sent it in on time (and have receipts to prove it), they told me 5 weeks later that the documents had not been on time and the "application was denied".

After the shock somewhat wore off I called them and they said the documents had been shredded, I could not talk to the mitigation officer who had signed the offer, that they were going to keep the deposit and that I had to start the whole process over. They would not talk about the documents at all and there was no one to talk to except the phone guard to explain that Saxon had actually signed for the documents and I had the FedEx proof of their signature.

Since then I have gone through my Senator and my case is being examined by the Attorney General's office. Meanwhile Saxon continues to tell me to send documents within 5 days; I sent this last batch with a checklist that THEY had sent and sent everything they wanted. When

I called a week later the phone person told me I needed to send more documents before they could assign it to a negotiator (and they need to assign it to a negotiator before they can put a hold on the foreclosure). When I told the phone person that I had sent in what they had listed; was she telling me that Saxon had not sent an accurate letter?

She said if I had had any questions about what to send in I should have called before I sent them in. I said "well, I didn't HAVE any questions because I was following what Saxon listed in the letter" She did not answer and just kept on condescendingly saying that I needed to send in another paystub and another bank statement and a W2 (even though I had sent a note in the fax explaining that one of us didn't GET w-2s and had sent a replacement document to show the year's income).

I asked to speak to someone to explain that to them and she said "you have to write a letter" (which will take 20 days, if I am lucky and by then the foreclosure will happen). I was recording the conversation (with her permission, of course) so I have proof of this merry chase/run around that they put you through. I will send documents that they requested in but they will no doubt say that I need the W-2, no matter how many times I explain it to them or they will say that I did not send the documents in in a timely manner (because they requested more documents which made me go past the "due date").

Surely this is all illegal. Breach of Contract and Failure to Act in Good Faith.

I will try the "Additional Help" on the right side of this web site. The Treasury apparently is sending out 3 person parties to check on the call centers but I bet they have not been to Saxon.
Who do we talk to about a class action suit? I am interested.
I have waited for a year to post here, but it is now obvious that a class action suit IS needed.

I understand everyones complaints with Saxon Mortgage. The best advice I can give, is to get your home refinanced with another company ASAP. We had to deal with their mess for over two years. It was a nighmare from HELL. When I called I never got to talk to the same person twice. No one ever returned phones calls as promised. One night when I was trying to get some answers my husband cooked suppper and eat too and I was still on the phone. Last year they sent me the 1098 in May. (Of course they were suppose to sent this out by January 31st. Then in June I received another one telling me that the interest I paid for the previous year was $6500.00, less than the first one. While, there was another call. This person was very helpful and gave me all the interest, principal, and escrow for that year. Which did add up. I tried to get them to fix it, they never did. Like that was a suprise. I tried to get someone to tell me where my $6500.00 went and no one could tell me. I talked to a lawyer and he sent them a letter telling them they had so many days to give me an itemized list of everything. I didn't get that either. So finally I got my house refinanced in November and now I can actually lay down and go to sleep at night. I really do not see how Saxon can stay in business. I first thought it was just me, but it looks like everyone has the same luck I did. I wish anyone that has to deal with Saxon the best. You will need it.

Hello again,
Good news I finally got all my ducks in a row and through the Attorney General Saxon was forced to resolve the issues I had with them. The had to put my account back into the positive and eat all those fees, they had tried to make me pay. all is back in the positive although the taxes are still off, but they will have to mail me a check at the end of the year... And I plan on getting it!! Of course they did apply my payment and took most of it for interest like the other client, but they had to get back the money they paid to the insurance co.

Dont give up and contact the Attorney General in your city and state and go after them. I now only deal with Adam in TX. and refuse to deal with anyone else, as he cleaned up the mess.
Good Luck and I will keep you all posted of any other mishaps.
